A. DECLARTIONS

The Re-establishing Government of Japan Empire (hereafter the Re-establishing Government)

based on:

 

  • a. Article 6 of Fourth Geneva Convention of 1949 (hereafter the Convention), the "re-establishment".
  • b. Article 70 Commentary Paragraph 2 “Treatment” of the Convention mentioned that, ‘It is thus the legislation of the occupied State, and not that of the Occupying Power’. The legislation of the occupied State shall have priority to the Occupying Power. It shall be an independent judiciary.
  • c. A “legal” Occupying Power (or Occupying force) does not have neither the jurisdiction of the Civil resources of occupied State, nor the Civil Judicatory of occupied State.
  • d. Meiji Constitution.
  • e. According to Title 32 of the United States Code of USA (United States of America, the Principal Occupying Power of Japan Empire). It states: “Civil government resources. Civil resources owned by, controlled by, or under the jurisdiction of civilian agencies of the U.S. Government, or of State and local government agencies. Civil resources. Resources that normally are not controlled by the Government, including workforce, food and water, health resources, industrial production, housing and construction, telecommunications, energy, transportation, minerals, materials, supplies, and other essential resources and services. Such resources cannot be ordered to support needs of the public except by competent civil government authority.”That is, the Re-establishing Government is a civil government re-established in occupied area of our State.
  • f. The Taiwan Governor-General's Office formally abolished on 28 May 1946. According to the Edict No.287(外地官署所屬職員ノ身分ニ關スル勅令) about the staff of overseas government officials, that abolished the Taiwan Governor-General's Office. Taiwan and Penghu supposed to be directly governed by the Government of Japan Empire. Therefore, the Re-establishing Government is named “the Re-establishing Government of Japan Empire”, neither “the Re-establishing Government of Taiwan”, nor “Taiwan Civil Government”.
  • g. The document of “皇紀2673 年平成25 年西元2013 年天長節賀壽文 ” dated 20 December 2013 by RCJE, had respectfully submitted it to His Majesty the Emperor, our Protecting Powers, Japan and ICRC.

 

For the purpose of:

a. Taking responsibility for the international community (to be “a peacefully inclined and responsible government”);

b. Rebuilding the government’s function of Executive, Legislative and especially impartial judicial system in the Occupied area of our State of World War 2;

c. Protecting the legal human rights of our country’s people, and protecting the legal human rights of the people who lives in the territory of our occupied State.

Declaration 1

We hereby declare that Re-establishing Government of Japan Empire(ReGovJE) is formed on 20 February 2014 (the World Day of Social Justice) by RCJE, at No. 81 Denglin Road, Wuku District, Taipei, Taiwan (Japan Empire), the Occupied area of our State of World War 2;

Declaration 2

The Re-establishing Government hereby declare that we understand and comply fully with all of the provisions of Fourth Geneva Convention of 1949, Third Geneva Convention of 1949, and all of the international conventions and customs of war;

Declaration 3

The Re-establishing Government, prior to restore the sovereignty of our country, appoint RCJE to identify people, educate true history and knowledge, elect officials, rescue and take care for the human rights of our people, correct social customs, plan policies, etc;

Declaration 4

The Re-establishing Government, we comply with guidance of, and suggestions of our Protecting Powers, Japan and ICRC.

Notes:

    • 1. As our original State, we use the name “Empire” with no any interest of imperialism. Please see " Empire and Subjects 20130927 " (Attachment 1), to use of this name, just because it was the original Sovereign status of our country before Occupied. According to the law, we have to restore, could further then modify the name.
    • 2. While the end of occupation, no matter the occupation is legal or illegal, our Sovereign State have been restored, we would modify "re-establishing government" to "government", and, our State may name "Great Japan ", or "the Japanese Commonwealth", may not name “Japan Empire”.
    • 3. If the United Nations Territory Trusteeship Council (UNTTC), the Principal Occupying Power - the United States of American (USA), the Protecting Powers - Japan and ICRC, have better ways to resettle our people (protected persons of Fourth Geneva Convention of 1949) to the country where we were living before occupied, so that we don’t need to form the Re-establishing Government, please notice us. And when the start of “resettlement” of our people, (i.e. any of our people had been ”resettlement” by UNTTC, USA, Japan or ICRC), the Re-establishing Government willimmediately disband.
    Attachment 2: the surrender agreement that shows our country before being occupied has two Sovereign entities. Attachment 3: Our government which issued currency before being occupied. ''

B. REQUESTS

  • 1. The re-establishing Government of Japan Empire request Protecting Powers according to Article 9 of, Article11 of Fourth Geneva Convention of 1949.
  • 2. The re-establishing Government request Japan to be the Protecting Power of the being occupied Japan Empire.
  • 3. The re-establishing Government request ICRC to be the Protecting Power of the being occupied Japan Empire.
  • 4. The re-establishing Government request Protecting Powers to station in Taiwan and Penghu.
  • 5. The re-establishing Government request Protecting Powers to protect our people’s human rights and benefits, prescribed by ‘the Geneva Conventions of 1949 and their Additional Protocols’.
  • 6. The Principal Occupying Power - the United States of American (USA), is obliged to help us to rebuild all the occupied civil governments under the supervision of Protecting Powers.
  • 7. The Principal Occupying Power - the United States of American (USA), the Occupying force acting on behalf of Allied Powers - Chinese Taipei, shall return the Taiwan Governor-General's Office and all local civil governments to the re-establishing Government under the supervision of Protecting Powers.
  • 8. Request China to assist the United Nations Territory Trusteeship Council, the Principal Occupying Power and our Protecting Powers in repatriating Chinese refugees back to China, according to Article 49 of Fourth Geneva Convention of 1949.
  • 9. Request Chinese Taipei - the occupying authorities, to stop violating the laws of war, to terminate the election of the ROC’s president in occupied area, to terminate the election of civil governments of Chinese Taipei, to stop voting by the Chinese nationals who even violate the ROC’s Nationality Law (Because there is no any Treaty change the nationality of inhabitants of Taiwan. Even, there is no any ROC’s law provide the inhabitants of Taiwan to acquire ROC's nationality).

E. Terms Definitions

  • 1. Japan Empire: The Empire of Japan. We use the name “Japan Empire”, as our original State, with no any interest of imperialism. The purpose for the term “Empire” is only to distinguish between the 1947’s independent Japan and the country where we were living before military occupation, called Japan too. Japan Empire has di-Sovereign Entities; they are the Emperor of Japan Empire and the Imperial Japan Diet that formed and pushed the Government of Japan Empire. Japan Empire performed the Meiji Constitution which mentioned in Article 4-4 of Taiwan Relation Act (1979):” Whenever the application of the laws of the United States depends upon the law that is or was applicable on Taiwan or compliance therewith, the law applied by the people on Taiwan shall be considered the applicable law for that purpose.” Japan Empire was fighting with the Allied Powers since 1941, surrendering on 2 September1945 and is now still under military occupation by the Allied Powers. On 3 May 1947 under military occupation, the Emperor of Japan agreed and the Peace Constitution performed. (The Peace Constitution rose up by the General MacArthur of Allied Powers and Imperial Japan Diet, the other Sovereign Entity of Japan Empire.) At this moment, the Sovereign Entity (i.e. the Government ) was independent from Japan Empire and Japan Empire began the temporary disappearance.
  • 2. Japan Peace: Japan, the Sovereign State started from 1947 when under military occupation, forced by General MacArthur with Peace Constitution to be independent and the country’s Sovereignty is on the people of Japan.

  • 4. RCJE: Rescue Committee for the people of Japan Empire
  • 5. ReGovJE: the Re-establishing Government of Japan Empire (REGOVJE)

  • 7. Formosa and Pescadores is the area where Qing Empire ceded in perpetuity to Japan Empire under the Treaty of Shimonoseki of 1895, listed in Article 19 of Five Power Treaty (Washington Treaty) of 1922 as territories of Japan Empire, is maintained the territorial integrity by Charter of the United Nations (came into force on 24 October 1945) and occupied by Chiang Kai-shek (who acting on behalf of the United States , the Republic of China, the United Kingdom and the British Empire, and the Union of Soviet Socialist Republics, under General Order No. 1) and his representatives (namely, Chinese Taipei) from 25 October 1945.

Empire

“Empire” is a historical term. However, our nationality called “Japan Empire” is characterization of international law. The purpose for the term “Empire” is only to distinguish between the 1947’s independent Japan and the country where we were living before military occupation, called Japan too. The sovereign structures of the two sovereign States (both named Japan) are entirely different.

Hence, we use the term “Japan Empire” not to mean that we assist Imperialism but only to distinguish the different Legal States in international law.

Let us review the history of human civilization. The Empire has important meaning in the history about forming Sovereignty of States. In 16 century to 19 century, Empire became an emblem of a Sovereign State. The Executive power, Legislative power, Judicial power, and Diplomatic power of a State, these powers are concentrated in the Emperor as if the Emperor is a representative symbol of Sovereignty as known as Sovereign entity. In that time period, almost all Sovereign States are called Empires, whether they had colonies or not. 

At that time, there were three kinds of people in the international customary law; they are citizens, nationals, and colonists. Citizens and nationals apply to International Human Rights law and colonists apply to the International Humanitarian law. The determination for lands to be a State’s territory or colony in the international customary law also depends on the human rights standards. Only the inhabitants of the lands were treated as citizens or nationals of a Sovereign State; the lands would be determined as the Sovereign State’s territories. On the contrary, treated as colonists they would be determined as a Sovereign State’s colonies.

After re-explanation of the definition of Japan Empire, (You could also review our “TAIWAN URGENTLY REQUEST PROTECTING POWERS” published on Aug. 16, 2013, there is a definition of Japan Empire in the document opening.), let’s go on with the term Japan Empire as our country’s name which does not involve any Imperialism.

Our country, the Japan Empire, did not have a colony. Formosa and Pescadores (Taiwan) is her territory. Because she treated the inhabitants well and fully respected. The situation was reported on September 24th, of the news “SAVAGE ISLAND OF FORMOSA TRANSFORMED BY JAPANESE “ by the New York Times. More than that, both the Five Power Treaty signed in Washington in 1922 and the Charter of United Nations came into force on 1945.10.24 confirmed that Taiwan is an indivisible territory of Japan Empire.

Japan Empire is essentially a State with confederation pattern like British Commonwealth. Compared to concepts of Human Rights in other States, at that time, Japan Empire is a Country that treated her people with high degree self-governing and respect. Historically, Japan Empire is not an Imperialism Country in the age of Empire. This name, Japan Empire, is an honor emblem of respect to Human Rights in human history, just as our county submitted the "Racial Equality Proposal" to the League of Nations In 1919, marked the Milestone of human civilization respect to Human Rights. Japan Empire is a democratic State with di-sovereign entities. One of the sovereign entities, the Imperial Japan Diet, is composed and on behalf of people. Please allow us to use Japan Empire as our nationality before the “resettlement” of us to the country where we were living, the country with Di-Sovereign Entities; they are His Majesty the Emperor and the parliament composed of people. The term of “resettlement” is explained in 4th Geneva Convention Art. 6 Commentary Para 4.

 

Subjects

Subjects in Meiji Constitution of Japan Empire are not enslaved social class. The implication is that the subjects are followers of morals. His Majesty the Emperor is good, representative of moral of “ideas” (the term ideas, comes from philosopher Plato), similar to Confucius in ancient Chinese Culture, like Jesus Christ in present Church.

All the people who have ethical manners and comply with laws called subjects in our country. This is the original and cultural form of our country.
